The case of four suspects charged with robbery with violence at the Kangundo Law Courts has taken a dramatic turn after the lead accused pleaded for a review of his bond terms on medical grounds.
Through his lawyer, Edwin Maucho, the key suspect, Duncan Wambua Kimeu, told the court that he has been suffering from diabetes and urgently requires specialized medical attention, continuous health monitoring, dietary management, and timely medication.
Maucho argued that his client’s continued detention under the current conditions amounted to a violation of his constitutional rights under Article 29(f) of the Kenyan Constitution, which protects individuals from cruel, inhuman, or degrading treatment.
“The accused humbly seeks the court’s indulgence to review the current bond terms so that he may access medical treatment at a facility of his choice,” Maucho submitted, proposing a reduction of bond from Ksh 5 million to Ksh 500,000, which he termed as fair and just.
He further dismissed allegations that his client had attempted to intimidate witnesses, saying that evidence presented during the trial proved that the phone number alleged to have been used in the threats did not belong to the accused.
“The complainant has already testified, and there is no risk of interference with witnesses. If the prosecution still feels there are threats, the Witness Protection Act provides a remedy,” the advocate added.
However, Prosecutor Vivian Nyangena opposed the application, arguing that the accused had not raised any health concerns throughout the trial and was now using the excuse to abscond court proceedings.
She told the court that the Machakos GK Prison Hospital was well-equipped to cater for inmates’ medical needs, including specialized treatment.
The case stems from an incident on April 29, 2024, in which retired Chief Physiotherapist Titus Muteti Kilika was allegedly robbed at Kambai Junction along the Kangundo–Mwala Road in Machakos County.
During the robbery, the victim reportedly lost a Samsung mobile phone, his national ID, NHIF and medical practitioner cards, several bank ATM cards (Equity, Family, Sidian, and Shirika), and cash totaling Ksh 1,503,111.
The four accused persons — Duncan Wambua Kimeu, Dennis Ndolo Mutunga, Wambua Kinyili Mutunga, and Charles Mutinda Margaret — are facing charges of robbery with violence.
The matter is before Principal Magistrate Sammy Opande. The case will be mentioned on December 16, 2025, while the ruling on the bond review application will be delivered on November 10, 2025.
