Mwala parliamentary aspirant Barckleih Kilei Mutinda is facing the prospect of having his movable property auctioned after the Machakos Small Claims Court issued warrants to recover a debt amounting to KSh256,039.
Court documents show that Mutinda is the respondent in a case filed by Denis Kituku Paul at the Machakos Small Claims Court under case number SCCCOMM/E080/2026.
According to the warrant of attachment issued by the court, Mutinda was ordered through a decree dated June 19, 2026, to pay the claimant KSh209,039, with an additional KSh47,000 in taxed costs, bringing the total amount due to KSh256,039. The document indicates that no amount had been paid on account at the time the warrant was issued.
The court subsequently directed Benson Munyao Mwau, trading as Milan Auctioneers, to attach Mutinda’s movable property to recover the outstanding amount. The warrant states that the property is to be held until further orders of the court unless the judgment debtor settles the amount due together with the costs of attachment.
A separate warrant of sale dated July 30, 2026, authorises the auctioneer to sell the attached property after giving the required 15-day notice and making the necessary proclamation.
The warrant directs the auctioneer to sell enough of the attached property to realise KSh256,039, described by the court as the amount of the decree and costs that remained unsatisfied.
The court documents were issued under the authority of Hon. Elisha D. Komora, the administrator of judgments at the Machakos Small Claims Court, with the warrant dated July 30, 2026.
The development comes as Mutinda positions himself for the 2027 Mwala parliamentary race, potentially putting the spotlight on the aspirant's financial and legal affairs as he seeks to build support ahead of the elections.
The court warrant, however, relates specifically to the recovery of the stated civil debt and does not, on its face, constitute a criminal finding against Mutinda.
The warrant requires the auctioneer to return it to court on or before September 29, 2026, indicating how it was executed or explaining why it was not executed.
