Wavinya Ndeti Questions Gachagua Ruling, Cites Constitutional Breaches in Senate Process

Machakos Governor Wavinya Ndeti has raised concerns over the High Court ruling that upheld the impeachment of former Deputy President Rigathi Gachagua, arguing that the decision highlighted serious procedural flaws in the Senate’s handling of the matter.

Speaking during a public address while inspecting ongoing and completed development projects across Machakos town, Governor Wavinya urged the former Deputy President to pursue further legal redress, maintaining that the impeachment process was tainted by constitutional violations.

She argued that even the court’s findings pointed to a breach of rights during the Senate proceedings, insisting that such a violation undermined the legitimacy of the entire process.

“The court itself found that the Senate wronged Gachagua. If that is so, he should have been reinstated as the Deputy President. The Senate therefore offended the Constitution by violating Gachagua’s rights to a fair hearing,” she said.

According to the governor, the infringement of constitutional rights during the proceedings rendered the impeachment process fundamentally defective.

Wavinya made the remarks during her Machakos Central Ward development tour, where she inspected several county projects. These included Kusyomuomo Health Centre, completed works in the St. Mary’s area, ongoing construction of T-Tot frontage slabs, drainage renovation, and landscaping works. She later engaged traders at Sokoni Market, interacting with both retail and mitumba business operators.
