Detectives from the DCI Headquarters’ Land Fraud Investigation Unit (LFIU) have arrested former Mathioya Member of Parliament Francis Njakwe Githiari over allegations of defrauding a couple Sh6.4 million in a controversial land deal in Ngong.
According to investigators, the former legislator entered into an agreement with the couple for the sale of a parcel of land, which was also to be developed into a double-storey residential house.
Githiari reportedly presented himself not only as the seller of the land but also as the contractor tasked with constructing the house.
The entire project was valued at Sh40 million, with the couple expected to make payments in instalments. As part of the agreement, the couple deposited Sh6.4 million into Githiari’s account.
However, trouble began when the couple made routine visits to the construction site and allegedly overheard claims that the ownership of the land was disputed. Reports emerged that other parties had already moved to court seeking to establish ownership rights over the property.
The revelation raised alarm among the buyers, prompting them to suspend any further payments as suspicions over the legitimacy of the deal intensified.
A detailed investigation by the LFIU later established that the funds had allegedly been obtained fraudulently.
Following completion of investigations, detectives forwarded a duplicate police case file to the Office of the Director of Public Prosecutions (ODPP), which approved recommendations to charge Githiari with obtaining money by false pretences contrary to Section 313 of the Penal Code.
The former MP was arrested on Thursday at his Karen residence and is currently being processed by detectives ahead of his arraignment at the Milimani Law Courts on Friday, May 15, 2026.
